TERMS & CONDITIONS

Applications that are submitted without trade references are subject to a minimum three (3) month C.O.D. trial period. During this three (3) month period, payments made by EFT must be pre-approved by management and be processed prior to delivery of the goods. RESTOCKING AND CREDITS

These are only accepted if authorised by Infiniti Group Australia and are notified within 48 hours of receipt of goods. Goods may only be returned by carrier approved by Infiniti Group Australia. A handling charge may apply to returned goods.

SPECIAL FEES AND CHARGES

A fees and charges charter covering urgent dispatch, late order, below minimum, returns and restocking is available on request from Infiniti Group Australia.

OVERDUE ACCOUNTS

Infiniti Group Australia reserve the right to charge overdue account fees not in excess of the current bank prime interest rate. Accounts outside of agreed trading terms may be placed on ‘stop supply’ until such time that the account is brought back into terms. Account trading terms may be permanently rescinded

at Infiniti Group Australia’s discretion due to prolonged and/or frequent default. An out of terms account may result in any negotiated volume rebates being withheld and 30 days beyond terms may forfeit the right to any claim by the buyer for a negotiated rebate.

ACCOUNT CLOSURE

All outstanding balances must be paid in full within 14 days of the closure/settlement date in the event of business closure or trade sale.

RETENTION OF TITLE

1. Title to the Goods shall remain vested with Infiniti Group Australia and shall not pass to the Buyer until the purchase price for the Goods has

been paid in full and received by Infiniti Group Australia. Until title to the Goods passes:

i. Infiniti Group Australia shall have authority to retake, sell or otherwise deal with and/or dispose of all or any part of the Goods;

ii.Infiniti Group Australia and its agents and employees shall be entitled at any time and without the need to give notice enter upon any

property upon which the Goods or any part are stored, or upon which Infiniti Group Australia reasonably believes them to be kept;

iii. The Buyer shall store or mark the Goods in a manner reasonably satisfactory to Infiniti Group Australia indicating that title to the

Goods remains vested with Infiniti Group Australia; and

iv. The Buyer shall insure the Goods to their full replacement value, and arrange for Infiniti Group Australia to be noted on the policy of

insurance as the loss payee.

2. Irrespective of whether title to the Goods remains vested with Infiniti Group Australia, risk in the Goods shall pass to the Buyer upon delivery.
